Terms of service
Version 3 · in force since October 4, 2026
These terms are the agreement between you and aiModelka. By creating an account you accept them; we record the moment you did. If you do not accept them, do not use the service.
What the service does
aiModelka takes photographs of a clothing item — the item alone, without a person — and produces photographs of that item worn by a generated model, in a pose and against a background you choose. A shoot gives you several options in 1K resolution; each option is already a finished photo that you can download. From any option you can then order a larger size — 2K or 4K — which is made separately.
The model wearing your item is a brand model: either one of the ready-made models the service provides, or your own. To create your own, you ask for a set of candidate faces, pick one, and the service builds the model from it; both steps cost credits. Sets of candidate faces are deleted 14 days after they were made; the face you picked is kept as part of your model.
The images are generated by an artificial-intelligence model. We describe below what that means for the result.
Your account
You need an account to use the service. Sign in with an email address and a password, or with Google.
Keep your access to yourself. Anything done from your account is treated as done by you, so tell us at [email protected] as soon as you suspect someone else has got in. Use a real email address you control — it is how we reach you and how you recover access.
One person or one business per account. We may block an account that breaks these terms, and we will say why.
Credits
Photos are paid for with credits.
- A shoot of one pose gives you one to three options — two unless you choose otherwise. Each option that was made costs 7 credits. An option is a finished photo in 1K resolution; downloading it is free. One more option for the same shot also costs 7 credits.
- A larger size of an option you chose costs 15 credits for 2K and 25 credits for 4K. A larger size is generated anew from that option, so small details may differ from it. Making the same size again costs the same.
- Your own brand model costs 40 credits: 20 credits for each set of four candidate faces, and 20 credits for building the model from the face you picked. The ready-made models are free to use.
- Downloading, cropping, the watermark and the "created with AI" label are free.
- The price of every paid action is shown on its button before you press it. If these prices change, a new version of these terms is issued.
- If the service could not make a photo, no credits are charged — whether our provider failed, the work did not complete, or the request was declined. A photo that was made is charged even if you decide not to use it: that is why a shoot starts with inexpensive options, and a larger size is ordered only for the one you chose. Credits spent on photos you later delete are not returned.
- A new account gets 75 credits to start with. These starting credits are granted once per mailbox: if you delete the account and sign up again with the same email address, or with one of its aliases, they are not granted a second time.
- How long unused credits are valid depends on where they came from. Credits of a subscription plan are valid until the end of the paid period they were granted for. All other credits — the starting credits, a credit pack, credits we add to your account and refunded credits — are valid for 12 months from the day they were granted. Credits that expire sooner are spent first.
- Credits are a unit of account inside the service. They are not money, they carry no cash value, and they cannot be transferred to another account or exchanged back into currency. Where the law of your country gives you a right to a refund, write to us and we will honour it.
Paid plans and credit packs are listed on the pricing page and in Account → Credits and plan. Card payments are not enabled yet. Until they are, choosing a plan there does not charge you: instead we offer the Starter plan free for 30 days, once per account and once per mailbox. Its credits are plan credits and are valid until that period ends. Prices shown on the pricing page are the prices we intend to charge when payments go live; the price of a plan or of a credit pack may change, but never for a purchase already made.
What you may upload
Upload only photographs you have the right to use:
- Photos of your own goods. That is what the service is built for.
- Not other people's protected images — someone else's product shots, catalogue photos, stock images or artwork you do not hold the rights to.
- Not photographs of real people to be used as a model. The model is generated; do not upload a person's likeness in order to reproduce it.
- No photographs of children — none at all. Whatever is in them and however the child is dressed: we do not process a child's image and do not pass it to the generation provider. Such a photo is refused on upload.
- Nothing illegal, and nothing that infringes another person's rights — including counterfeit goods, sexual content, content involving minors, hate, and violence.
Photograph the item on its own — laid flat, on a hanger, or on a mannequin, whole in the frame, front and back separately. This is not only a rule: it is what produces the best result, because when the item is worn by a person, the AI has to separate the garment from the body, and details get lost. An adult in the frame is not forbidden — the result will simply be worse.
The service does not cover children's clothing. The model wearing your item is always an adult, so a child's garment would come out worn by a grown person.
Do not try to bypass the limits of the service — automated mass requests, sharing one account across many people, or attempts to reach data that is not yours.
Every photo is checked automatically before it is stored. The check runs on our own servers — the photo is not sent anywhere for it — and it answers one question: does this look like an item of clothing, footwear or headwear, photographed on its own. A photo that does not pass is refused as it arrives and is never written to disk: we keep no copy of it, not even a thumbnail. One consequence is worth stating plainly — because nothing is kept, we cannot look at a refused photo afterwards, so if you believe a photo was refused wrongly, describe the item to us or send a different photo.
If a submission breaks these rules, we may refuse it, remove it, and block the account. Our provider applies its own content filters, and a generation may be refused on that side too.
What you get, and who owns what
Your uploads stay yours. You give us only the permission we need to run the service: to store your photos, to send them to our generation provider, and to produce the images you asked for. We do not use your photos to train models, and we do not publish them anywhere.
The generated photos are yours to use — in your shop, in marketplaces, in advertising — subject to the provider's terms that apply to the underlying model (Gemini API Additional Terms of Service). We claim no ownership over them.
We cannot promise that a generated image is unique: a model can produce similar results for similar requests, for you and for someone else.
What AI generation means for the result
The result is produced by a model, not by a camera. Two things follow, and both are your call:
- The result may differ from what you expected — in the drape of the fabric, in a print, in small details, in hands. This is normal for generated imagery and is not a defect of the service. That is why a shoot gives you several options to choose from: you look at them and decide which one, if any, to use and whether to order a larger size. You are the one who chooses which photo to use, and you decide whether it represents your goods honestly.
- Every generated image carries an invisible machine marking (SynthID) placed by the provider, which identifies it as AI-generated. We do not remove it. The separate visible "created with AI" label is a setting in your account; where the law requires you to disclose that an image was generated — the EU AI Act, Article 50, applies from 2 August 2026 — meeting that duty when you publish the image is your responsibility. We give you the tool; we cannot know where you will publish.
The service does not verify that generated photos accurately depict the goods you sell. Consumer-protection law in your country does apply to that, and it applies to you as the seller.
Availability
We aim to keep the service running and useful, but we do not promise uninterrupted availability. Maintenance, provider outages and failures happen. Generation queues may be limited per account so that the service stays responsive for everyone.
The service is provided as it is. We do not warrant that it will meet a particular commercial goal, that a photo will increase your sales, or that a result will suit a specific marketplace's rules.
Limits of our liability
To the extent the law allows, we are not liable for lost profit, lost sales, lost data beyond what our own backups can restore, or consequences of publishing a generated image. Our total liability for any claim is limited to what you paid us in the twelve months before the claim arose.
Nothing here removes rights the law gives you that cannot be waived — in particular consumer rights.
Ending the agreement
You can leave at any time: delete your data or delete your account entirely in Account → Data. Deleting the account ends this agreement. Unused credits are not refunded in money when you leave.
We may suspend or close an account that breaks these terms, that is used for illegal purposes, or that threatens the service. Where we can, we warn first.
While an account is closed, you cannot delete it yourself — the interface is shut to you, including the deletion page. Write to [email protected] and we will either reopen the account or delete it for you. Deletion does not clear the record of the closure: the same mailbox signing up again gets a closed account.
Changes to these terms
When these terms change, the version and date at the top change with them. Material changes are announced by email before they take effect; continuing to use the service after that means you accept the new version.
Governing law
These terms are governed by the law of Romania. Disputes we cannot settle by writing to each other are heard by the courts of that jurisdiction, without prejudice to the protections of the country where you live if you are a consumer.
